ACKNOWLEDGEMENT OF SAFETY BRIEFING

Adventure Paddlers Indemnity Agreement

Special Notices:

1. Weather(including rain, haze & wind) is important. Once out at sea, while is at your discreation to manage adverse wind/rain condition, you are required to download MyENV for updated weather(esp lightning) alerts.

2. No entry into all rivers along Pasir Ris Beach;

3. Extra charge of 20% for equipment not returned to rack (upon completion of usage) by customers;

4. LIFE JACKET must be worn. It is your responsibility to wear it.

5. Additional charge of min 20% if kayaks are being dragged on land(instead of being carried off ground).

6. There is a risk of illness(e.g. gastrointestinal) if the water is swallowed during water activity. Advisory precautionary measures:

Minimise the time immersed in water as far as possible.
Rinse face and hands with clean water after completing the activity.
Wash hands thoroughly before eating or handling food.
Visit a doctor if you are feeling unwell after engaging in the activity.

7. For unguided rentals: Relevant paddling competency is mandatory.

8. Tidal is important. Avoid launch and return at low tidal. Tidal available at https://www.nea.gov.sg/corporate-functions/weather/tide-timings. It is at your discretion to manage low tidal conditions.

9. Strictly No crossing of Shipping channel(between Pasir Ris & Ubin Island) when there are approaching powered vessels.

10. Beyond padding, hazards are found on land/ shoreline/ beaches as well. E.g. Be wary of slippery grounds(oil/water/algae etc) , sea creatures, rocks, hazardous objects etc.

11. If you have any health issues(includes Aqua-phobia) complicating your participation, you must not proceed further.

12. Full charges based on actual time start upto end time to be applied regardless of any delays due to natural/non natural occurrences(e.g. rain/currents/wind/rescue/exhaustion/no watch to check time/lack of competency/lost/equipment failure/etc).

13. Additional charges(minimum SGD80 per pax) to be applied for recovery of personnel and/or equipment;

14. Test all equipment within 10mins after launch. You must return equipment for exchange(equipment issues ONLY) if there are any visible issues. If not returned for exchange within 10mins, equipments are deemed sound and full charges are to be applied.

YOU ARE REQUIRED TO APPROACH STAFF ON ANY CONCERNS BEFORE LAUNCH.

Step 1 of 3 - Indemnity Agreement - Section 1

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK & INDEMNITY AGREEMENT

This Agreement covers use of water sports equipment and services provided by and/or participation in events organized by Adventurepaddlers PTE. LTD.

IN CONSIDERATION of being permitted to hire, participate, compete, officiate, observe or work or in any way in the EVENT(S) EACH OF THE UNDERSIGNED, for themselves, their personal representatives, heirs, and next to kin:

ASSUMPTION OF RISK

Participant in open sea activity is not without risk, which may result in injury or even death. The hazards include risk of injury from the equipment rented, strong seas, thunder & lightings, strong winds (e.g. Sumatras), reefs, rocky coasts, ocean currents, exposure, marine life, and other people in or on the water, etc. By signing this contract, I hereby represent that I understand the inherent dangers of any of the watersports activities offered by Adventurepaddlers PTE. LTD. and am well-awared of the risks involved. I assume all risks of bodily injury or death occurring in connecting with my use of any of the equipment or services. I will allow no others to use the equipment, except those who have co-signed this contract and whose safety I am responsible for.

RELEASE AND INDEMNIFICATION

I and all co-signatories hereby release and exempt AdventurePaddlers PTE. LTD., its operators, directors, agents, shareholders, officers and employees (hereinafter called 'Released Parties'/'Releasees') from all liability for personal injury, property damage, wrongful death and causes of action of any kind caused in whole or in part by the negligence of the Released Parties, or arising from the rental or use of the equipment or howsoever caused. I further agree to defend and indemnify the Released Parties from any claims, demands and liabilities of any kind whatsoever (including legal fees and medical evacuation costs) arising from the rental or use of any of the equipment made available to me and co-signators of this contract.

LIFE JACKETS

I and all co-signatories undertake at all times to use a personal floatation device.

EQUIPMENT RESPONSIBILITY AND SECURITY DEPOSIT

I hereby agree that I shall be fully and unconditionally responsible for using all equipment, in a safe and responsible manner and shall abide by the instructions given to me. I shall also be fully responsible for any passengers I take, who must first co-sign this contact and agree to be bounded by all the terms in particular above clauses.
I agree to be liable for any lost, stolen or damaged equipment at its new wholesale price. Kayaks that are cracked or creased in the hull, craft that are cracked or creased in the hull or rails; or masts that are bent or cracked or sails that are torn or ripped, paddles that are cracked or creased, during the entire period of usage by me and/or co-helper in all and any circumstances are considered destroyed. I am aware of the charges for rescue operations. All or any option of my security may be applied to any obligations hereunder.

HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the promoters, participants, associations, sanctioning organizations or any subdivision thereof, operators, owners, officials, craft owners, rescue personnel, any persons, promoters, sponsors, advertisers, expedition guides, owners and lessees of premises used to conduct the EVENT(S), premises and event inspectors, surveyors, underwriters, consultants and others who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the premises or EVENT(S) and each of them, their directors, officers, agents, employees and affiliates, all for the purpose herein referred to as "Releases," FROM ALL LIABILITY TO THE UNDERSIGNED, his/her personal representatives, assigns, heirs, and next of kin FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFORE ON ACCOUNT OF INJURY TO THE PERSON OR PROPERTY OR RESULTING IN DEATH OF THE UNDERSIGNED ARISING OUT OF OR RELATED TO THE EVENT(S), WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

HEREBY AGREES declares that I am in good mental and physical condition, and not under the influence of any medications that will impair my judgment.

HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releases and each of them FROM ANY LOSS, LIABILITY, DAMAGE, OR COST they may incur arising out of or related to the EVENT(S) WHETHER CAUSED BY THE NEG-LIGENCE OF THE RELEASEES OR OTHERWISE.

HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE arising out of or related to the EVENT(S) whether caused by the NEGLIGENCE OF RELEASEES or other-wise.

HEREBY ACKNOWLEDGES THAT THE ACTIVITIES OF THE EVENT(S) CAN BE VERY DANGEROUS and involve the risk of serious injury and/or death and/or property damage. Each of THE UNDERSIGNED, also expressly acknowledges that INJURIES RE-CEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES OF THE RELEASEES.

HEREBY AGRESS that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by the Releases, INCLUDING NEGLIGENT RESCUE OPERATIONS and is intended to be as broad and inclusive as is per-mitted by the laws of the Province in which the Event(s) is/are conducted and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

HEREBY AGRESS TO ALLOW BEING PHOTOGRAPHED AND THE USE OF ANY PHOTOGRAPHS WITHOUT COMPENSATION.

HEREBY ACKNOWLEDGES and accepts the applicable charges to be paid, including the additional SGD80 (per participant) to search and rescue operations which may be initiated at the discretion of the Adventurepaddlers PTE. LTD.

HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

THIS RELEASE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF SINGAPORE.
